a.. <br /> Y <br /> III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Tom Kaldenbach of DRMS. Ryan Sweetwood of <br /> Mountain Coal Company represented the operator. Photographs taken during the inspection are <br /> attached to the end of this report. With the operator's consent, this report was issued from the Denver <br /> office of DRMS. <br /> The longwall was active in E-Seam Panel 1. The site was free of snow and the ground was dry. <br /> Hydrologic Balance <br /> The two synthetic-lined cells of the Refuse Pile Expansion pond appeared in good shape (see photo). <br /> The upper cell contained water several feet deep, and was not discharging to the lower cell. The lower <br /> cell contained a small pool of water and was not discharging. <br /> Most of the channel of Sylvester Gulch from the mine pumping discharge site to Highway 133 was <br /> inspected and no adverse impacts from mining were found. Stream buffer zone markers were properly <br /> displayed. <br /> Processing Waste <br /> The face of the Refuse Pile Expansion (RPE)pile appeared stable as viewed from the bottom of the <br /> slope(see photo). The slope has a good cover of grass and survey markers were in place. The <br /> operator is backhauling its refuse from the Bowie No. 2 Mine wash plant to the RPE where it was <br /> being incorporated into lifts on top of the pile. <br /> Support Facilities <br /> The road to methane drainage well 19-06 in Box Canyon was inspected. The road and well pad were <br /> in good shape, with no excessive erosion. Well 19-06 was operating. <br /> General Mine Plan Compliance <br /> The operator appeared to be following the approved mine plan. <br /> Subsidence <br /> Stream flow in Sylvester Gulch was observed upstream and downstream from the area recently <br /> undermined by the southwest corner of B-seam Panel 25. No loss of streamflow was apparent where <br /> the stream crossed over the panel. This undermined area was inspected along the valley bottom of <br /> Sylvester Gulch. No signs of subsidence were found. <br /> 3 <br />
