III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This partial inspection of the Carbon Junction Coal Mine was conducted by DRMS staff from the <br /> Durango Office at 691 County Road 233, Suite A 2, Durango, CO 81301, phone (970) 247-5469. Five <br /> photos accompany this report. No individuals were contacted and no activities were observed during <br /> the inspection. <br /> Public access to the permit area is controlled by a locked gate at the mine entrance. Previously, <br /> unknown individuals have driven four-wheel drive vehicles around the locked gate. Barriers, <br /> composed of large boulders and/or ditches and earthen berms, were constructed beside the north and <br /> south sides of the entrance road at the gate to discourage unauthorized access to the permit area. <br /> However, unknown individuals continued to drive around the north barrier. The north barrier has been <br /> extended to discourage unauthorized access to the site. <br /> As shown in the photos, Sediment Pond 1 has been backfilled. Topsoil Stockpile 8, previously located <br /> adjacent to the west side of the pond, has been removed. The area previously occupied by Sediment <br /> Pond 1 and Topsoil Stockpile 8 has been graded to blend with the adjacent agricultural field. The <br /> sediment containment ditch, previously routing disturbed area drainage from the south end of the <br /> Equipment Storage Area to Sediment Pond 1, has been backfilled and graded to blend with the <br /> surrounding topography. Approximately 1,300 feet-of a second sediment containment ditch, <br /> previously routing disturbed area drainage from the northern portions of the permit area to Sediment <br /> Pond 1 (East Collection Channel), has been backfilled and graded to blend with the surrounding <br /> topography. Reclamation backfilling and grading of the East Collection Channel terminated at the <br /> second set of triple culverts for an access road to the Mutual Use Area. Backfilled and graded areas <br /> appeared stable, evidence of settling, slumping orexcessive erosion was not observed. Rows were <br /> evident from the grass drill and crimping of the mulch. <br /> As noted above, the lower portion of the East Collection Channel has been reclaimed. The inlet or <br /> mouth of the East Collection Channel has been closed by backfill. Upland drainage and drainage <br /> from the North Pit area is now routed to the Carbon Junction Diversion. However, the remaining <br /> portions of the East Collection Channel, approximately 3,600 feet in length, appeared intact and <br /> capable of collecting drainage from reclaimed lands and concentrating such drainage at the mouth of <br /> the triple culverts. <br /> The embankment for Sediment Pond 2, located at the vest side of the permit area, has been <br /> removed. Earthen material from the removed embankment had been distributed at the base of the <br /> steep slopes immediately north of the pond. The sediment containment ditch, previously routing <br /> affected area drainage to the pond, has been graded to form a bench which traverses the fill slopes <br /> immediately east of the pond. <br /> The North Pit area was not inspected. <br />
