III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This partial inspection of the King Coal land 2 Mines was conducted by DRMS staff from the Durango <br /> Office, located at 691 County Road 233, Suite A 2, Durango, CO 81301, phone (970) 247-5469. <br /> Operations were active at both sites. Five photos of the King Coal 1 Mine accompany this report. <br /> King Coal 1 Mine <br /> Mine identification sign and permit boundary markers were posted. Grading of the Refuse Disposal <br /> Pile was occurring. Equipment utilized at the RDP included a bulldozer, Cat 815F compactor, and a <br /> 324D excavator. As shown in the photos and discussed below, there exist several maintenance <br /> issues at the King Coal 1 Mine needing the Operators attention. <br /> The East Diversion routes upland drainage around the east side of the yard area. As shown in the <br /> photo, a portion of the ditch was partially obstructed by earthen material. Maintenance for the upper <br /> reach of the East Diversion appears necessary to ensure the capacity and continued function of the <br /> structure. Other portions of the East Diversion, consisting of the rock lined channel, buried culvert and <br /> open ditch with sediment sump (lower reach) appeared clear and stable. Debris screen was not <br /> present at the inlet to the buried culvert. <br /> The South Diversion routes upland drainage, generated from the watershed located south of the yard <br /> area, under the yard via a culvert. As shown in the photos, the inlet of the culvert was partially <br /> obstructed by soil sloughing and the outlet of the culvert was partially obstructed by sediment. <br /> Affected area drainage from the upper yard area is conveyed to the West Sediment Pond by a series <br /> of buried culverts. There are three drop-inlets to the culverts located in the upper yard area. As <br /> shown in the photo, the uppermost of the drop-inlets, located nearby the coal conveyor, was not <br /> located and appears to have been buried in sediment and debris. The second of the drop-inlets, <br /> located nearby the shower house, appeared clear and functional; debris screen was intact. As shown <br /> in the photo, the debris screen for the third of the drop-inlets, located nearby the scales and office, has <br /> fallen into the inlet. <br /> The drainage swale in the entrance road, which directs yard drainage to the East Sediment Pond, was <br /> intact. The sediment traps for the portions of the entrance road located outside of the sediment <br /> containment system appeared intact and functional. The East and West Sediment Ponds were <br /> holding water, visually estimated at two foot depth and approximately six feet below discharge levels; <br /> no discharge was observed from either pond. The primary spillways were clear and functional. <br /> King Coal 2 Mine <br /> The sediment pond was dry. Sediment containment ditches appeared clear and functional. <br />
