Landowner request letters are contained in Appendix 20-2.1 of this attachment; SCC is waiting on receipt of some <br />letters. Permanent pond demonstrations, documentation of State Engineer approval and necessary water rights <br />information for each pond will be submitted when completed and prior to bond release request. <br />Stock Ponds <br />Rationale: There are ten (10) stock ponds (T-2, 3, 5, 18, 20, 22, 24, 25, 26, and 27) proposed to remain permanent <br />following reclamation. These permanent stock ponds will enhance the approved post mine use. <br />Justification: The stock ponds were constructed in reclaimed area and are not primary sediment control structures. <br />They have a storage capacity of less than two-acre feet and an embankment no greater than five feet high measured <br />from the invert of the spillway to the upstream toe of the embankment. Given that the stock ponds are relatively <br />small in size and there are no residential or commercial structures or mining operations immediately below the <br />structures, they do not create a threat to public health and safety or threaten significant environmental harm. <br />Documentation: The pond locations are shown on Exhibit 20-2, Post Mining Topography and Drainage. <br />Landowner request letters are contained in Appendix 20-2.1 of this attachment; SCC is waiting on receipt of some <br />letters. Permanent pond demonstrations, documentation of State Engineer approval and necessary water rights <br />information for each pond will be submitted when completed and prior to bond release request. <br />Miscellaneous Boundary and Grazing Fences <br />Rationale: Interim fencing has been established towards the need for special management or consideration of the <br />ongoing mining operation. However, upon completion of reclamation activities, permanent fencing will be <br />constructed. The final fencing patterns will approximate premining patterns or current property owner boundaries <br />at the time in order to restore the premining pasture units. <br />,Justification: There are a variety of fences that will be left as permanent within the permit boundary following <br />reclamation. There are fences delineating the boundaries between the various surface land owners and some areas <br />of the reclaimed area have fences to establish separate grazing pastures within the reclamation to promote <br />revegetation to meet success criteria for designated post mining land use. <br />Documentation: Exhibit 20-2, Post Mining Topography and Drainage, shows the actual and proposed locations of <br />the fences, while the landowner request letters are contained in Appendix 20-2.1 of this attachment. <br />20-2.5 03/09 <br />TR-62
