C 1982-056) <br />TR61, Additional information regarding 6MN Water Storage Reservoir <br />Dear Mr. Vanarelli: <br />The Division has received additional information regarding permitting of a water storage reservoir at the <br />Foidel Creek Mine by Twentymile Coal Company (TCC). The application for this reservoir was initially <br />found complete by the Division of Reclamation, Mining and Safety on August 2, 2007. Notification was <br />provided to your office at that time requesting the Office of the State Engineers (SEO) comments <br />regarding the proposed reservoir. The Division received your reply on August 10, 2007. At that time you <br />indicated that the operator (TCC) needed to obtain a substitute water supply plan through your office, or a <br />water court approved augmentation plan. <br />It is the Divisions understanding that TCC has been in communication with SEO regarding designs and <br />approvals for this 6MN Mine Water Storage Reservoir. TCC is providing revisions to the design to lower <br />the elevation of the emergency spillway discharge. TCC believes that this reduction in emergency <br />spillway elevation would classify the impoundment as a non jurisdictional impoundment. The maximum <br />design mine water storage volume would be reduced accordingly. The embankment height and <br />dimensions, except for the emergency spillway, would remain generally unchanged. <br />I am providing a copy of TCC's August 18, 2008 letter and revised pages and designs for the 6MN Mine <br />Water Storage Reservoir. Please provide your comments to the Division as soon as possible. The <br />operator is anticipating commencement of construction of the reservoir as soon as approvals have been <br />received.
