Ms. J0111111 Williams <br />October 31, 2007 <br />Page 4 <br />To offset evaporative and operational lagged depletions accrued from August 2004 <br />through September 2008, 120`i' Estates Partners must replace 3.64 acre-feet of water for the <br />remainder of 2007, 14.16 acre-feet in 2008, 2.72 acre-feet in 2009, and 0.05 acre-feet in January <br />2010. Because 90% of the depletions impact the South Platte River within 15-months, the <br />depletions remaining after January 2010 (approximately 0.15 acre-feet), were wrapped into the <br />depletions in the prior months. <br />REPLACEMENT WATER SOURCES <br />Nontributary Well Water <br />The augmentation water from the nontributary Laramie-Fox Hills well (Permit No. <br />64401) will be pumped into the Henderson Water Ski Lake, and the accretions then lagged to the <br />river. In the interim before the slurry wall is approved and lagged accretions are insufficient to <br />frilly offset depletions, water will be leased from the City of Brighton. If necessary, water from <br />the well may also be trucked to, and then discharged into, the South Platte River. 1201h Estates <br />Partners has also previously delivered nontributary well water by hose to the Brighton 124"' <br />Avenue Pipeline that discharges directly into the South Platte River and may utilize this <br />discharge method in the future. <br />The nontributary well water pumped into the Henderson Water Ski Lake will be <br />delivered directly by hose, as shall well water pumped into the Brighton Pipeline. The Brighton <br />Pipeline is fully enclosed from the 124`i' Avenue intake point, where 120`1' Estates Partners will <br />release its well-pumped augmentation water, to the river discharge location. Finally, well water <br />conveyed to the river by truck will be discharged in the proper location in proximity to the pit, <br />thereby negating the need for assessment of transit losses. <br />T ernnorar-r, Lease ofAtrnentation Water Torn the City of Bri lrton. <br />Water leased from the City of Brighton will consist of fully consumable Fulton Ditch <br />water. The leased augmentation water will be released to the South Platte River at Brighton's <br />Midland augmentation station or Brighton's 124`h Avenue or Kent Mitchell Lake storage <br />facilities. A temporary lease from the City of Brighton was previously approved under the prior <br />SWSP and amendments thereto. A copy of the agreement between 1201' Estates Partners and the <br />City of Brighton for the leased water will be submitted upon execution of the agreement. Mr. <br />Bob Stahl, the water commissioner for District 2, confirmed that no transit losses would be <br />assessed since the augmentation stations are located downstream of the depletions. <br />A schedule of anticipated monthly discharge volumes into the Ski Lake and the resultant <br />lagged accretions, as well as the leased City of Brighton deliveries, is attached as Table 3. <br />Martin and Wood Water Consultants, Inc.
