Submittal of Bond Release Application and <br />Completeness Determination by the Division <br />The Division received CEC's bond release application SL-2 on August 25, 2004, and found the <br />application complete on October 15, 2004, after the Division received proof of publication of the <br />applicant's public notice. The completeness determination was made in accordance with Section <br />3.03.2(1)(d). <br />CEC submitted the bond release application following the procedures described in the Act and the <br />Regulations. The application also utilizes the Division's Guideline Regarding Selected Coal Mine <br />Bond Release Issues, dated April 18, 1995. <br />Public Notice <br />CEC published notice of the bond release application in the South Weld Sun once weekly for four <br />consecutive weeks, beginning on September 2, 2004. CEC also notified landowners within and <br />adjacent to the mine permit area, and other interested parties of the application for bond release, as <br />required by Section 3.03.2(1). <br />Bond Release Inspection <br />The Division conducted a bond release inspection on November 22, 2004. The operator waived the <br />30-day inspection window in an email on October 26, 2004. The site inspection was conducted in <br />accordance with Section 3.03.2(2). Tom Kaldenbach represented the Division. CEC was <br />represented by Donald MacDonald and Danny Kipp of CEC, and Mike Savage of Savage and Savage <br />Environmental (CEC's consultant). CEC owns all of the land surface and coal in the bond release <br />area. The Division notified neighboring landowners and the Office of Surface Mining of the <br />inspection, but they did not attend. The Division's inspection report is on file at the Denver office of <br />the Division of Minerals and Geology. <br />Technical Review <br />The Division reviewed technical aspects of CEC's bond release submittal in order to determine if the <br />requested bond release is warranted. The Division also independently analyzed various hydrologic <br />impacts. The Division's review of CEC's bond release application found the application to be <br />technically adequate, as submitted, and therefore the Division had no technical adequacy questions <br />for CEC. <br />Chronology of Division's Review of Bond Release Application <br />The Division conducted an analysis of CEC's hydrologic impacts. The analysis covered data cited in <br />the bond release application, information in the permit application, and CEC's past annual hydrology <br />reports.
