f) Location, number of acres, and date of planting of all previously vegetated areas: 356.5 acres.
Reclamation and seeding dates are described in the text, but a description of the seed mix should be
included as well.
2) Additional info as committed to in the permit:
KCC's cover letter describes sealing five (5) monitoring wells, but does not discuss how these wells
were sealed or final disposition. The ARR is the record to state how the wells were sealed, graded and
seeded. Please include description of how the wells were sealed, finished, and seed mix used for final
reclamation.
KCC also provided the Annual Reclamation Report form for the year 2008. This form appears to have
several discrepancies in the reported acreage. The Division reviewed all previous bond release
approvals (SL1, SL2, SL3, and SL4), and tallied phase I bond Release acreage as 388.6. Phase II
released equal 388.6 acres, as well. The Division and KCC are in agreement that phase III bond release
acres equal 372.7.
Based upon page 6 of KCC's ARR, The values reported on the ARR form for "acres seeded" need
correction. Under the heading, "10 year or less" there should be 14.9 acres (8.0 +6.9). The column,
"Greater than 10 years" should total 345.6 acres (page 6 of 2008 ARR). As the Division continues to
approve bond releases on the remaining operations at the Marr Mine and Loadout, critical accounting of
the reclamation status of the remaining acres will help at the time of final bond release. .
Please make corrections to the "Annual Reclamation Report for the Year 2009" form. Please find a copy of
KCC's 2008 ARRR form enclosed with the requested corrections marked on the copy. Please include more
detail to the description of sealing the five monitoring wells, as well as the seed mix used to seed the drill
rig disturbance, and a rough estimate of the acres (<1 acre, <0.5 aces?) associated with reclaiming the
monitoring wells.
Please contact me if you have any questions regarding this review.

(303) 8
Protection Specialist II
C:\jhb\C80006\ARR\2008 ARR review.doc
