III. COMMENTS - COMPLIANCE <br /> Colowyo C-1981-019 <br /> 27 April 2009 <br /> Pg 114 <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken <br /> during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the Colowyo Mine conducted by Jim Stark of CDRMS. <br /> The inspection was conducted on 27 and 28 April 2009. Ryan Pawlowski of CCC <br /> accompanied me on 27 April 2009 and Kurtis Blunt of CCC accompanied me on 28 <br /> April 2009. The mine was actively mining coal and hauling coal to the loadout at the <br /> time of the inspection. The weather was cool and sunny on 27 April and cool, sunny <br /> and very windy on 28 April 2009. The ground was muddy in spots on both days and <br /> all of the snow at the site has melted. <br /> Signs and Markers: - The Mine ID and blasting notification signs were in place at the <br /> main gate and at the entrance to the four ponds along Colorado Highway 13 <br /> (Streeter, Gulch A, Prospect and Section 28). <br /> - The stream buffer signs were in place along the Taylor Creek. <br /> Roads: - The main access road and haul road to the Gossard Loadout is a paved <br /> road. The road was dry and in good condition. <br /> - The light-use road in the Taylor Draw (to the West Pit, East Taylor and West Taylor <br /> Ponds) was mostly dry at the time of the inspection. There were some muddy spots <br /> at the crossings to the sumps. The road does have some minor rutting but Kurtis <br /> indicated that the road would be bladed this spring. Overall the road is stable and <br /> well maintained. <br /> - The haul roads in the East Pit, West Pit were all stable and well maintained at the <br /> time of the inspection. There was not a problem with fugitive dust from the roads <br /> and no erosional problems were noted. <br /> - Colowyo was working on the in-pit portion of the haul road proposed in Technical <br /> Revision 76. They were working in the West Pit, north of the active operations. Since <br /> this portion of the road is in-pit, it does not require the permitting and design <br /> requirements for haul roads. There is a portion of this road along the Taylor Draw that <br /> is not in-pit and is required to be designed and permitted according to Rule 4.03.1 . <br /> The Division is currently evaluating these designs as part of the TR-76 submittal. The <br /> Division sent out a preliminary adequacy review letter on 24 March 2009 and is <br /> awaiting responses from Colowyo. <br /> - The haul roads in the South Taylor Pit were all dry and there was not a problem with <br /> fugitive dust at the time of the inspection. There was at one time a road that went to <br /> the bottom (underdrain area) of the C-C' portion of the East Taylor Fill but this road <br /> has been covered with spoil material. <br /> - The Sturgeon road was accessible at the time of the inspection. The road was well <br /> maintained and stable and there were no erosional problems noted. The Missouri <br /> crossings along the road remain in good condition. <br />
