This will be for compliance to the Board Order Notice of Violation <br />No. MV-2008-014. <br />The applicant has had the site surveyed by Terry Surveying on December 2, 2008. You <br />and I visited the site on April 14, 2009. After that visit it was determined that for clarity <br />and a better layout of the mine site the amendment should increase the acreage of the <br />permit. This permit amendment application will address that issue. As you know I asked <br />for an extension of time to prepare this application to be submitted by May 7, 2009. <br />The applicant has increased the acreage by 10.31 acres. This will encompass some of the <br />pre-permit disturbed area that was not addressed in the earlier permit and make sure that <br />the haul trucks will not drive over lands that are not in the permitted area. New maps <br />have been produced for use in the future, which will make it easy to know where the <br />permit boundary is located. Enclosed in the amendment are the following new maps: <br />INDEX MAP <br />PER-MINING MAP <br />MINING / SOILS & VEGETATION MAP <br />RECLAMATION MAP <br />Since the original permit package was submitted the NRCS Soil Units names have been <br />changed, therefore we have enclosed the new soils unit names for additional clarity. We <br />have also added more readable climate information. A new legal description of the permit <br />boundary has been included in exhibit "A". We have tried to present only new <br />information however some of the original permit package is enclosed for convenience.
