The rangeland seed mixture has been used to seed disturbance areas at the Seneca H and Yoast mines.
• It lends itself to rapid and long-term surface stabilization, ease of establishment, maximum use of
native species, high levels of utility for livestock and wildlife, good forage production potential,
compatibility with naturally regenerating native species present in replaced topsoil and the ability to
be self-sustaining. With this in mind and in accordance with CDOW's mission to promote greater
sage grouse habitit, mountain big sage brush at a rate of 0.25 pounds per acre PLS will be included in
the Rangeland Seed Mixture for all disturbances within the Seneca H permit area (ccu034, ccu035,
ccu036, ccu037, ccu041, ccu042 and ccu045).
The seed mixtures Sage Creek proposes to use on the private surface have previously been
approved by the surface estate owners under access agreement negotiated as part of the 2008
exploration program (approved under X-2009-229-01).
6) Threatened or Endangered Species
Review by the CDOW did not identify any potentially impacted Threatened or Endangered (T&E)
species or associated habitats requiring avoidance or specific mitigation measures. CDOW's
consultation is provided in Appendix C.
The exploration and reclamation activities will not jeopardize the continued existence of an
endangered or threatened species listed pursuant to Section 4 of the Endangered Species Act of 1973
(16 U.S.C. 1533) or the Nongame, Endangered or Threatened Species Conservation Act (Section 33-
8-101 et. seq. C.R.S.) or result in the destruction or adverse modification of critical habitat of those
species.
0 7) Confidential Materials
Sage Creek has not requested that any material in this Exploration NOI be considered confidential.

Sage Creek Project -1009 NO]
04/08109 16
