Noble Underbrink sent me this
message with a couple of pictures showing where they back filled the ditches that had been
exposing water. There was some question as to whether they were exposing groundwater or ditch
return water, but I believe we were going to take the stand that they need to augment their
evaporative depletions in either case. So Noble decided that the easiest way to alleviate
the issue would be to backfill the ditch so that water was no longer exposed. I hope that
this resolves your issue and I will continue to monitor occasionally to insure that there are
no water rights issues on this property.
Neal Misbach
Colorado Division of Water Resources
Water Commissioner - District 51
P.O.
