Cattany <br /> Division Director <br />Foidel Creek Mine Natural Resource Trustee <br />29515 Routt County Road No. 27 <br />Oak Creek, CO 80467 <br />RE: First Quarter 2008 Discharge Monitoring Report, CO-0036684 <br />Dear Mr. Watterson: <br />Twentymile Coal Company (TCC) submitted NPDES Discharge Monitoring Report (DMR), for First <br />Quarter 2009, Colorado Department of Public Health and Environment CDPS permit no. CO-0036684 on <br />April 30, 2009. This CPDS permit has one outfall, Pond E at the Fish Creek Tipple, which discharges to <br />Fish Creek. Outfall 001 A discharged the last two weeks of March. Water quality samples were collected <br />and analyzed and WET tests were conducted. No inorganic parameters were exceeded, and WET tests <br />passed for both fathead minnow and Ceriodaphnia dubia. Please note that the cover letter states that <br />Outfall 001A discharged during the quarter, parameter values were recorded, and water samples were <br />collected, but the box on page 1 of the DMR form is checked, indicating that no discharge occurred. Please <br />correct this record. <br />The report is in compliance with Rule 4.15.13(2)(iii). Thank you for prompt submittal of this report. <br />Sincerely, <br />Janet H.
