Keenesburg Midterm 5 Page 2 May 1, 2009 <br />Section II- Revisions Since Last Renewal, November 3 2006 <br />One technical revision (TR39) and one minor revision (MR43) have been approved since permit renewal <br />No. 5 (RN5). TR39 was approved April 14, 2008. TR39 approved a change in the post-mining land use <br />on several acres to industrial (oil and gas well development). A third party petroleum development <br />company drilled two gas wells and constructed associated facilities on the Keenesburg permit area. <br />These gas wells and their associated facilities were located in areas that had previously been reclaimed. <br />Minor Revision No. 43 was approved on March 20, 2009. MR43 extended the duration for CEC's <br />variance from contemporaneous reclamation. CEC's reclamation schedule is based on the rate of flyash <br />placement into Pit B. This extension for the variance from contemporaneous reclamation allows CEC to <br />continue to accept flyash and continue reclamation activities as permitted. <br />At the time of this midterm review, CEC had submitted a revision to revise the final contours of the long <br />term spoil storage area (TR40). TR40 has not been approved at the time of the Midterm 5 review. CEC <br />had also submitted a bond release application (SL4) requesting phase III bond release on 165.29 acres of <br />areas that had previously been approved for phase I and I bond release. The SL4 bond release <br />application had not been found complete at the time of the Midterm 5 review. <br />No violations have been issued to CEC for the Keenesburg Mine in the past three years. <br />Section III-Status of Permit Stipulations <br />There are no current stipulations on Permit C1981-028. Stipulations 1, 2, 3, 4, 6, 7, 8, 9, 10, 11, 12, 13, <br />14, 15, 16, and 18 of the original permit were resolved during the first five-year permit term. <br />Stipulations 19, 22, and 27 were resolved during the second five-year permit term (Findings, 1992). <br />Stipulations 20, 21, and 28 were resolved during the third five-year permit term (Findings, 1998). <br />Stipulations 5, 17, 23, 24, 25, 26, 29, 30, and 31 were resolved during the fourth five-year permit term <br />(Findings, 2001). <br />Section IV-Decision to require Revisions or additional information <br />Ownership and Control information is found in section 2.03.4 of the permit. This section was last <br />updated during RN5 review in 2006. Since that date, several mergers and business sales have occurred <br />with Coors Energy Company's parent company. Please ensure that this ownership and control, and <br />officer, information (including start dates and end dates) remains up to date in the permit. If changes <br />and updates are needed, please provide this information with a minor revision to the permit. <br />Section 2.03.4(6) contains information regarding surface and mineral ownership of land within the <br />permit area. Recent oil and gas well drilling has indicated that mineral rights have been severed from <br />CEC. Please update this section with current ownership of surface and mineral ownership, and please <br />update the appropriate maps as necessary.
