MCM 2009-064 <br />Planning Department No. 2008-0788 CUP1 <br />RECEPTION #: 2484543, 5K 4832 PG 505 04,15 2009 at <br />08:37-36 .AM, 1 Or 6, R $0 00 S $0.00 <br />Janice Rich, Mesa County, CO CLERK AND RECORDER <br />APPROVAL OF A CONDITIONAL USE PERMIT TO ALLOW MINING OF SAND <br />AND GRAVEL LOCATED AT THE CORNER OF D ROAD AND 32 1/2ROAD. <br />WHEREAS, Austin Civil Group, on behalf of the property owner, Clifton Sanitation <br />District, requested approval for a Conditional Use Permit to excavate sand and gravel from three <br />parcels totaling 82.77 acres in size in the Agricultural, Forestry, Transitional zone located, as <br />shown on attached Exhibit "A" and more particularly described on attached Exhibit "B ", Legal <br />Description and <br />WHEREAS, the attached Exhibit "C" is the mining plan for the proposed use, and <br />WHEREAS, the staff recommendation was contained in a staff report dated February 12, <br />2009, and amended March 5, 2009, and <br />WHEREAS, the Mesa County Planning Commission recommended approval with <br />conditions at their February 26, 2009, public hearing, and <br />WHEREAS, the public hearing before the Mesa County Board of County <br />Commissioners was held on March 17, 2009. <br />NOW, THEREFORE, THE BOARD OF COUNTY COMMISSIONERS OF THE <br />COUNTY OF MESA FINDS AS FOLLOWS: <br />THAT public notice requirements of Section 3.1.8 of the Mesa County Land <br />Development Code (2000, as amended) have been met. <br />THAT the 32.5 Road Conditional Use Permit located at 3299 D 1/2 Road, Clifton, can <br />meet (with compliance with conditions) the applicable Approval Criteria for a Conditional Use <br />Permit (Section 3.8.7), the General Approval Criteria (Section 3.1.17), and the Mining and <br />Extractive Uses (Section 5.2.13) of the Mesa County Land Development Code (2000, as <br />amended). <br />THAT this request is in accordance with the health, safety and welfare of the residents of <br />Mesa County. <br />Page 1 of 6
