1 12 APPLICATION PAGE 15 OF 35 <br />• (8.) No agriculture or horticulture use is expected at the site. <br />(9.) Imported backfill material may be required for this project. In the <br />case that inert fill is required the Operator will follow the guidelines <br />outlined in section 3.1.5.9. The Operator will provide the State the <br />notification required by this section, and use inert fill material. <br />(10.) All surface drainage within the project site will be graded such that <br />it will drain towards the ponds located in the center of each of the <br />respective mining areas. <br />(11.) No unauthorized releases of pollutants to groundwater are <br />expected from this project. <br />3.1.6. Water <br />(1) A water augmentation plan is not required for this site. The applicant will <br />also be required to monitor groundwater discharged from the site in <br />accordance with the State of Colorado Discharge requirements. <br />Settlement ponds constructed as part of the mining operation. will be <br />removed during site reclamation work. <br />(2) A settlement pond will be constructed as part of the mining dewatering <br />process and will be located near the northwest corner of the project <br />site. The pond is required to meet the Colorado Department of Public <br />• Health and Environment's requirements for a discharge permit. <br />Construction of the settlement pond will not damage adjacent <br />properties or structures <br />(3) All surface areas and stockpiles will be protected against wind and <br />water erosion. Surface areas will be kept moist, or sprayed with <br />magnesium chloride, to control airborne pollution, and all surface areas <br />within the site will be graded to provide positive drainage towards the <br />mine area or site retention pond. <br />3.1.7. Groundwater <br />The applicant will obtain a CDPS Industrial General Permit for Sand and <br />Gravel Mining and Processing from the State of Colorado Water Quality <br />Control Division. The applicant will also obtain the Colorado Division of <br />Water Resources Gravel Pit Well Permit. The operator will comply with all <br />permit limits established by the State Agencies for these permits. <br />3.1.8. Wildlife <br />The site currently has minimal vegetation and offers little cover for wildlife <br />species. The Division of Wildlife has provide documentation which indicates <br />the project will not impact threaten or endangered species, and is not <br />critical habitat.
