III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DRMS. No one represented the <br />operator during the field inspection or the records check. There was no snow at the mine site. <br />Roads <br />The road going up Hubbard Creek canyon was dry and in good shape. The mine road across Hubbard Creek was <br />also dry and in good condition. The light use road that leads to reclaimed pond 5 was dry and passable, although <br />a couple of 2 foot diameter rocks fell onto the edge of the road from the adjoining rock cliff. <br />Signs and Markers <br />The mine id sign was on the mine entrance gate and contained the required mine information. The records <br />location sign was also up on the entrance gate. Surface disturbance markers, which are white pvc pipe, were up <br />around the disturbed area. <br />Hydrology <br />The diversion ditches at the top reclaimed bench and at the toe of the reclaimed benches that channel runoff <br />around the backfilled mine slopes were well vegetated and had sufficient capacity. The same was true of the <br />upper diversion ditch at the reclaimed coal stockpile area. <br />Reclamation <br />The seed at reclaimed pond 4 and pond 5 has not germinated yet. The silt fence was in place at the downgradient <br />ends of both reclaimed ponds. There were no indications of erosional problems. <br />There were no signs of erosional problems at the reclaimed mine slopes and benches. There was a good <br />vegetative cover at the site. There was no evidence of slope instability with the reclaimed slopes. There were a <br />few seeps on the backfilled mine slopes. <br />A little water was seeping out of the north and central underdrains of the backfilled mine slopes. A few short <br />sections of 18 inch diameter black plastic pipe were still sitting on the reclaimed coal stockpile area site. <br />Records <br />The mine records are located in the Clerk and Recorder's Office in Delta. The required records were examined <br />and were found to be in compliance, as documented on the attached records checklist. <br />c:/word2007/blueribbon/inspO4O9
