III. COMMENTS-COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during the
inspection. Comments also describe any enforcement actions taken during the inspection and the facts or
evidence supporting the enforcement action.
This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.The Hawk's Nest Mine is a
revoked underground mine site that was reclaimed with forfeited bond money. Since October 22,2005,the
inspection frequency has been one complete and three partial inspections per year.
There is a reclaimed west side of the mine and a reclaimed east side of the mine. The site was basically dry,
although there had been a recent precipitation event. There was no snow at the site.
West Side
The county road that runs alongside the west and east sections of the reclaimed mine site was passable. There
was access to the west side of the reclaimed mine site since no coal train was blocking the entrance road that
leads to the DMEA substation. The entrance road was dry. There was a good cover of vegetation at the mine
site. The well cap was on the groundwater well pipe and stream buffer zone signs were up.
There was a little standing water in the sediment pond. The pond embankment appeared to be stable and the
single concrete spillway and half culvert down drain were in place. The pond inslopes and outslopes were well
grassed.
East Side
The two small mudslides adjacent to the north side of the county road did not encroach upon the road. The two
riprapped channels that receive runoff from the two county road culverts were functional. Also functional was
the riverside berm. There were no indications of slope instability or erosional problems with the backfilled
areas.
c:/word2007/hawksnest/inspO4O9
