III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division) on 20 April 2009. The weather was clear and the mine <br /> site was wet and partially snow covered during the on-the-ground inspection of the site. There was <br /> locations of substantial amount of snow cover throughout the mine site and access to the entire mine <br /> site was not feasible by road do to snow cover. A portion of the inspection was conducted from <br /> County Road 29 to the west of the mine site. <br /> Signs and Markers <br /> The mine I.D. signs were in place at the entrance of the Old Tipple Road entering the mine area to the <br /> south, the access road off of County Road 78, the Oak Creek Facilities Area and the North Road <br /> entering the mine area from the north. All mine I.D. signs were in compliance with all required <br /> information displayed and no problems noted at the time of the inspection. <br /> Roads <br /> The Old Tipple Road, North Road, Lower Moffat Road, Center Ridge Pond Road, West Ridge Pond <br /> Road, and West Ridge Road were covered with a substantial amount of snowfall and access was <br /> either limited or inaccessible. Portions of the North Road the Old Tipple Road, Lower Moffat Road, <br /> Center Ridge Pond Road, West Ridge Pond Road, and West Ridge Road were inspected from <br /> County Road 29. All roads were stable with no problems noted at the time of the inspection. Culverts <br /> and roadside ditches were snow covered. <br /> Hydrologic Balance <br /> All sediment ponds were holding water at the time of the inspection. All embankments appeared to <br /> be stable with no visible signs of erosion or damage. <br /> The Moffat Pond, Center Ridge, and West Ridge ponds contained water at the time of the inspection. <br /> All embankments were stable with no problems noted. The primary spillways were functioning as <br /> permitted and the emergency spillways were in compliance with no problems noted at the time of the <br /> inspection. <br /> The four Moffat down drains were wet and stable with no evident signs of damage. No water was <br /> observed flowing in the drains at the time of the inspections. <br /> The "string-of-pearls" permanent drainage channel was stable and holding water in 5 impoundments. <br /> The area appeared to be stable with no signs of damage. <br />
