III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division) on 22 April 2009. The weather was clear and the mine <br /> site was dry during the on-the-ground inspection of the site. Scott Wanstedt of BME accompanied the <br /> inspection. <br /> The mine is currently operating as permitted in panel LWB-10. No drilling activities were in progress <br /> during the inspection. <br /> Roads <br /> The paved Deserado Mine Road appeared to be well maintained and in good condition. The haul <br /> road from the facilities area to the refuse disposal area was dry and stable and displayed good <br /> drainage with no problems noted. The conveyor corridor road, access roads and light-use roads were <br /> wet with patches of snow cover and in good condition with no problems noted. All roadside ditches <br /> and diversions were snow covered at the time of the inspection. <br /> Processing Waste <br /> Refuse Pile - 2/3/4 was well compacted and stable at the time of the inspection. Grading appeared to <br /> allow good run-off to ponds. No problems were noted. Refuse Pile - 5 appeared to be well <br /> compacted and stable. Both sites appeared to show good run-off to the ponds via the collection <br /> ditches. Coal Mine Waste was being stockpiled at RP-5a at the time of the inspection. Waste was <br /> being spread throughout the refuse piles at the time of the inspection. <br /> General Mine Compliance <br /> Sheep was being graved along county road 67 during the inspection. The current post mining land <br /> use is livestock grazing. The sheep heard appeared to be grazing as expected on the mine site with <br /> no substantial damage noted. <br /> Overall, the Deserado Mine is in good condition and appears to be conducting operations as required. <br />
