III. COMMENTS - COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during
the inspection. Comments also describe any enforcement actions taken during the inspection and the
facts or evidence supporting the enforcement action.
This was a complete inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining
and Safety. The mine is a reclaimed surface mine. The weather was very windy and dry. The Mine site
was free of snow with the soil surface moist from recent precipitation but not muddy. The main gate on
the mine access road remains locked.
Roads: The mine access road was dry with no problems accessing the remaining liability areas. Access
road to the load out was dry and in accessible as well.
Records: As noted in the records section of this inspection, decision and findings for SL4 needs to be
filed with the records at NWCC. A copy of the replacement bond needs to be placed on file as well.
KCC needs to keep files maintained at NWCC up to date. Copies of 2008 quarterly Pond inspections
were copied by NWCC and provided to the inspector.
Hydrologic Balance: The Load Out pond was discharging clear water. Ice was melted off the load out
pond with no maintenance concerns noted.
Reclamation Success: The Division continues to retain liability bond for two reclaimed areas at the
mine site, encompassing 8 acres as well as the access road. The Division continues to retain liability
bond for the Load out as well. Vegetation on the remaining liability areas of the mine(SE of Shop &N
W of Pond A) is good. Vegetation has not begun to green up. No active erosion features or new gullies
were encountered during the inspection.
Offsite support facilities: There has been no new activity at the load out with the exception of footprints
in the snow to the pond. The gate remains locked. No problems noted with the load out pond or with
the reclaimed load out area.
Vegetation at the Load Out remains in good condition.
