Kimberly K. Frick
April 28, 2009
Page 3
demonstrate that the net effective replacement equaled or exceeded the total
depletion on a monthly basis. All replacement water must be concurrent with
depletions in quantity, timing and location, except that releases may be
aggregated at the discretion of the Division Engineer. Said accounting must be
received by the 10th of the month following the reporting period.
9. The name, mailing address, and phone number of the contact person who will
be responsible for operation and accounting of this plan must be provided on the
accounting forms to the Division Engineer and Water Commissioner.
10. Should this substitute water supply plan expire without renewal or be revoked prior
to adjudication of a permanent plan for augmentation, all excavation of product
from below the water table, and all other use of water at the pit, must cease
immediately.
11. In accordance with amendments to Section §25-8-202-(7), C.R.S. and "Senate Bill
89-181 Rules and Regulations" adopted on February 4, 1992, the State Engineer
shall determine if this substitute water supply plan is of a quality to meet
requirements of use to which the senior appropriation receiving the substitute
supply has normally been put. As such, water quality data or analyses may be
requested at any time to determine if the requirement of use of the senior
appropriator is met.
12. Acceptance of these conditions is assumed unless a letter to the contrary is
received by this office, the Rege Leach, Division 7 Engineer (Rege Leach, 160
Rockpoint Drive, Suite E, Durango, CO 81301) and the District 71 Water
Commissioner (Denise Miller, 60 South Cactus Street, Cortez, CO 81321) within
two weeks of your receipt of this letter.
Please contact Melissa Peterson of this office or Rege Leach, Division 7 Engineer,
in Durango at (970) 247-1845, if you have any questions concerning this approval.
Sincerely
Kevin Rein, P.E.
Assistant State Engineer
Attachments: Tables 1, 2, 3 and 4
cc: Rege Leach, Division Engineer
Scott Brinton, Assistant Division Engineer
Denise Miller, Water Commissioner
Division of Reclamation, Mining, and Safety
