Box 46667 <br />Denver, CO 80201-6667 <br />Re: Munger Canyon Mine (Permit No. C-1981-020) <br />Phase I Bond Release (SL-1) <br />Dear Mr. Fulton: <br />Thank you for your letter dated March 26, 2009 regarding your concurrence with the Phase I <br />Bond Release Proposed Decision document prepared by the Division of Reclamation, Mining <br />and Safety (DRMS) for the Munger Canyon Mine. In reviewing your letter it appears that there <br />is an error on the second page. In the third to last paragraph, OSM concludes that CAM met or <br />exceeded the requirements for Phase I bond release on the 18.5 acres requested. CAM requested <br />18.5 acres but the DRMS is releasing Phase I liability on onlyl7.2 acres. The 1.3 acres excluded <br />from release will be eligible for Phase I bond release after the culverts are removed and low- <br />water crossings/dry fords are installed along the former haul road on BLM administered surface. <br />No further correspondence is necessary from the OSM, we simply wanted to make note of the <br />acreage discrepancy.
