III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator,the Bear Coal Company. The company's water sampler,Ron Hanna,was on site for field <br /> measurements of the hillside spring water treatment pond.No reclamation work had been performed since the <br /> last inspection. <br /> Roads <br /> The paved haul road was passable and in good condition. There was no debris on the road. The cable guard was <br /> on the outside edge of the road. <br /> Sims and Markers <br /> The mine id sign and its post were on the ground at the top of the hill and need to be put back up. The"no <br /> trespassing"sign was on the entrance gate. <br /> Hydrology <br /> The hillside spring water treatment pond was discharging at about 10 to 15 gpm. The color of the discharge was <br /> the usual orange color,which had been determined previously to be in compliance with water quality standards. <br /> The water level in the treatment pond was about 8 inches below the horizontal pipe,which is the normal <br /> situation.No problems were noted with the pond's discharge structure. <br /> The water level in the mine's only sedimentation pond was about two feet below the elevation of the primary <br /> discharge pipe. The gated valve on the primary discharge pipe was closed. The pond's emergency spillway had <br /> sufficient capacity. <br /> There were no issues with the two alluvial wells. The wells' caps were on the well pipes. The riverside berm had <br /> sufficient height and the collection ditch that leads to the sedimentation pond had sufficient capacity. <br /> Reclamation <br /> The reclaimed east half of the hillside mine disturbance area had a good vegetative cover and appeared to be <br /> stable. The west half continues to show instability. <br /> Noxious Weeds <br /> There were several tamarisk plants growing in the hillside spring water treatment pond.
