I11. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Backfill & Grading <br /> • Two excavators were parked at the D-Seam portal bench (Figure 3). It appeared that there <br /> is still some grading work to be finished in the middle upper reaches of the East Mine. <br /> • The long slope across the former crushing and screening bench appears to have passed the <br /> winter with no signs of erosion. The surface was uniformly roughened,which effectively slows <br /> the velocity of any water passing over the surface and has prevented the formation of rills <br /> and gullies. Rocks were randomly scattered over the surface of the eastern portion of the <br /> slope, which has been blended into a natural sandstone cliff (Figure 4). <br /> Fish & Wildlife <br /> Abundant elk prints were observed throughout the West and East Mine areas. At the West Mine, <br /> the skeletal remains of an elk carcass were scattered down the reclaimed surface. <br /> Reveaetation <br /> • Revegetation efforts at the reclaimed West Mine are impressive. Much of the slope is <br /> covered, and the new season's growth was just beginning at the time of the inspection. The <br /> Division believes that the operator might consider the pursuit of Phase II bond release for this <br /> portion of the permit area. <br /> • At the East Mine, a few grasses were beginning to sprout on the reclaimed slope over what <br /> was previously the crushing and screening bench. <br /> Bowie No. 1 Mine C-1981-038 15&16-Apr-2008 <br /> -2- <br />
