I11. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
Backfill & Grading
• Two excavators were parked at the D-Seam portal bench (Figure 3). It appeared that there
is still some grading work to be finished in the middle upper reaches of the East Mine.
• The long slope across the former crushing and screening bench appears to have passed the
winter with no signs of erosion. The surface was uniformly roughened,which effectively slows
the velocity of any water passing over the surface and has prevented the formation of rills
and gullies. Rocks were randomly scattered over the surface of the eastern portion of the
slope, which has been blended into a natural sandstone cliff (Figure 4).
Fish & Wildlife
Abundant elk prints were observed throughout the West and East Mine areas. At the West Mine,
the skeletal remains of an elk carcass were scattered down the reclaimed surface.
Reveaetation
• Revegetation efforts at the reclaimed West Mine are impressive. Much of the slope is
covered, and the new season's growth was just beginning at the time of the inspection. The
Division believes that the operator might consider the pursuit of Phase II bond release for this
portion of the permit area.
• At the East Mine, a few grasses were beginning to sprout on the reclaimed slope over what
was previously the crushing and screening bench.
