In addition to the requirements of the above referenced Rules, under Rule 4.2.1(4) the Division <br />cannot require financial warranty greater than the amount necessary to ensure reclamation of <br />all lands to be affected in said year, plus all lands affected in previous permit years and not yet <br />fully reclaimed. <br />The Division's cost estimation totaling $51,293 appears to be in accordance with Rule 4.2.1(4) <br />and represents the minimum amount of financial warranty the Division can accept for the first <br />year of operations at the Mud Creek Pit. Please note that financial warranties, minimized in <br />accordance with Rule 4.2.1(4), may be subject to review and adjustment on an annual basis. <br />Pursuant to Rule 1.15(1)(a), the Division may require the annual report to include a current <br />evaluation of the financial warranty. <br />The Division's cost estimation totaling $114,864 appears to be in accordance with Rule 6.4.12 <br />and represents an amount of financial warranty typically not subject to annual review and <br />adjustment. Such financial warranty extends flexibility to the expanding operation. <br />Therefore, please submit financial warranty in an amount not less than $51,293. Although the <br />permit has been approved, the Division cannot issue the permit until we receive appropriately <br />executed.financial and performance warranties and fully approve such warranties. Mining <br />activities may not commence until the permit is issued. <br />As noted above, the permit was approved on June 11, 2008. Pursuant to Rule 4.1(2), if the <br />Division has not received the appropriately executed financial and performance warranties <br />within one calendar year, by June 11, 2009, the Board shall reconsider the previous permit <br />approval.
