DESCRIPTION OF OPERATIONS <br />Cripple Creek & Victor Gold Mining Company (CC&V) is finalizing a feasibility study for a potential Mine <br />Life Extension (MLE) project associated with the existing Cresson Project. The reserve additions within <br />the Cripple Creek Mining District suggests an opportunity to extend the current mine life of the project <br />from 2012 until about 2016 with processing to continue until approximately 2024. <br />The proposed MLE mining operations will be a continuation of the current mining methods being <br />employed. The operations will be closer to the City of Cripple Creek and the town of Goldfield; therefore <br />closer to occupied residences or public accessible buildings. The mining operations would involve the <br />following noise sources. <br />¦ Stripping and stock piling of growth medium and overburden using dozers, front end loaders, motor <br />graders and haul trucks. <br />¦ Drilling and loading of blast holes using rock drills and service vehicles <br />¦ Loading of fractured rock using front end loaders, shovels and haul trucks. <br />¦ Routine mine surface preparation and maintenance using dozers and motor graders. <br />¦ Mine reclamation using haul trucks, dozers, motor graders and other service vehicles. <br />B. APPLICABLE LAWS AND ORDINANCES <br />The incorporated municipalities of Cripple Creek and Victor and the community of Goldfield do not have a <br />noise ordinance that addresses noise emissions associated with mining activities. Teller County does <br />have a section in the Teller County Land Use Regulations - 11-30-2003, which along with other <br />environmental factors includes noise. This section of that regulation is replicated as follows. <br />EX-10 EXTERNAL EFFECTS. External effects include noise, dust, odor, blowing or flowing materials, <br />heat fumes, smoke, vibration including blasting, air pollution and water pollution. <br />The tract for a proposed use shall be large enough and/or reasonable safeguards shall be provided <br />so that the external effects of the proposed use on adjoining properties, as measured at the property <br />boundary or project boundary (whichever affords the greater level of protection to the adjoining property) <br />shall not exceed standards contained in or referenced by the Colorado or Federal statutes, regulations, or <br />ordinances, as they may be amended. <br />The standard to be applied shall be that for the adjoining parcel, as illustrated by the following <br />example: if an industrial use is proposed to be located next to a Residential Property, the external effects <br />of the industrial use shall not exceed the standards for the residential use at the boundary between the <br />industrial use and the Residential Property. For the purpose of determining the external effect, an <br />adjoining agricultural property shall be considered a Residential Property. <br />This section EX-10 does not apply to agricultural uses. <br />Section EX-10 of the Teller County Regulations states that "standards contained in a reference by the <br />Colorado or Federal statutes, regulations, or ordinances, as they may be amended": The applicable law <br />is the State of Colorado Revised Statutes, Volume 8, Titles 25-28, Article 12, Noise Abatement. Section <br />25-12-103, "Maximum Permissible Noise Levels" limits the noise level for Residential Zones to 55 dB(A) <br />daytime (7:00a.m. to next 7:00p.m.) and 50 dB(A) nighttime (7:00p.m. to next 7:00a.m.). Using the State <br />of Colorado Noise Law as the standard then the noise level at any residential or agricultural zone <br />adjacent to the CC&V mine shall not exceed 55 dB(A) during the daytime and 50 dB(A) during the <br />nighttime. <br />For most noise sources such as those associated with mining equipment, the A-weighted, slow setting of <br />the sound level meter is the accepted measurement method. <br />The Teller County Planning Commission issued a Written Findings dated June 27, 2000 approving a <br />variance to allow a 5 dB(A) increase to the daytime and nighttime noise limits for residentially zoned <br />properties as specified in the State of Colorado Noise Law CRS 25-12-103. The variance is only <br />applicable to property, parcel or tract that is not occupied for residential purposes.
