• The Appendix CC-10, Section 3 regulations require a substantial amount of information, <br />presumably anticipating mining proposals in new or green fields areas. The MLE is an extension <br />of the existing Cresson mine, within approved permit boundaries, using approved mining and <br />reclamation practices. Much of this information is duplicative of that previously provided under <br />the Amendment No. 8 and associated Technical Revisions. Key information required for this <br />submittal is brought forward while other information is provided through specific reference to <br />the Amendment No. 8 application or provided in the attached OMLR application. <br />Due to the quantity of information required to be provided, and specifically because much of the <br />information pertains to an already approved and operating property, CC&V requests those third <br />parties reviewing the project with Teller County recognize that the approved Cresson Project is <br />not the subject of this submittal, rather it is the proposed MLE activities. CC&V requests your <br />assistance in providing this guidance. <br />The Project Elements <br />The proposed MLE activities are internal to the Mining Overlay District Boundary. Land <br />included within the MLE Permit Boundary is owned or controlled by CC&V unless otherwise <br />shown. Land ownership is described in Attachment 1, Table 2 to this application. <br />Portions of the MLE affected areas are located closer to the permit boundary and closer to <br />habitable structures than previous activities in the permit area, hence noise analyses, noise <br />• mitigations and noise monitoring are provided to assure compliance with the stipulated <br />residential noise standards. A noise report is provided as Attachment 8. <br />There are changes to traffic patterns on public roads associated with implementation of the MLE <br />and relocations and realignments and upgrades to Teller County roads will be required. A revised <br />traffic study is provided as Attachment 5 to address these changes. <br />Blasting and associated seismic monitoring will continue as per approved practices. Specific <br />blasting scaled distance information has been developed for the Amendment No. 8 Cresson <br />Project and is applicable to the proposed MLE activities. Additional blast monitoring is <br />recommended and proposed for the Cripple Creek side of the project in the attached OMLR <br />application. <br />Air quality is regulated under CC&V's facility wide air quality permit issued by the Colorado <br />Department of Public Health and Environment. CC&V continues to monitor air quality at the <br />Rigi Monitoring Station in accordance with the monitoring requirements of the permit. An <br />application for modification of the air quality permit is being requested as part of this permitting. <br />As discussed in Attachment 1 of this application Teller County will be kept informed of permit <br />changes with copies of any new issued permits provided within 30 days of issuance. <br />There are no new proposed water discharge permits or water related permits required for the <br />MLE. The site wide storm water designs have been updated and the design report is included <br />• with the application plan as Attachment 10. The Storm Water Management Plan will be updated <br />to address changes in the mining plan.
