Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division received your above referenced response in regard to Compliance Problems 1 and 2 <br />identified in the report of the inspection conducted on February 26, 2009. The status of the <br />corrective action is as follows: <br />Compliance Problem 1: Permit boundary was incorrectly delineated. <br />This problem is considered resolved as a result of the Operator's submittal of a map showing the <br />correctly delineated boundary. <br />Compliance Problem 2: Failure to account for permanent man-made structure. <br />This problem is considered resolved as a result of the Operator's submittal of a letter from <br />Western Area Power Administration, authorizing mining to within 37.5 feet of the Hoyt-Wiggins <br />transmission line. <br />If you have any questions, please give me a call at (303) 866-3567 x8116. <br />Sincerely, <br />Michael A.
