Russell Means
Environmental Protection Specialist
Division of Reclamation, Mining, & Safety
1313 Sherman Street, Rm. 215
Denver, CO 80203

Re: Nuvemco LLC, Last Chance #3 & #4 (Permit No. M-2008-012) (CHS # 52272)
Dear Mr. Means:
C0-01
c
APR L 7 2009 >/
Division or rtectamation, 1,
Mining and Safety
Thank you for your correspondence dated April 16, 2009 (received by our office on April 20, 2009)
concerning the project listed above which is located on lands managed by the Bureau of Land
Management.
A search of our files indicates that at least four surveys have been conducted for cultural resources in
the vicinity of the proposed permit area. Several cultural resources have been recorded in the permit
area that are either eligible for the National Register of Historic Places (NRHP) or that lack an official
determination of eligibility. Proposed mining activities should avoid adverse effects to these sites. If
site avoidance is not possible, we recommend further consultation with our office in order to identify
options to avoid, minimize, or mitigate the adverse effect to the sites.
Since there is Federal agency involvement in this project, please note that it is the responsibility of
the Federal agency to meet the requirements of Section 106 of the National Historic Preservation
Act as set forth in 36 CFR 800 ("Protection of Historic Properties"). This includes the identification
of any historic properties (i.e. cultural resources which are eligible for or are listed in the NRHP)
within the area of potential effects and determining whether the undertaking will have an effect
upon such properties. The State Historic Preservation Office, Native American tribes,
representatives of local governments, and applicants for Federal permits, licenses or other approval
are entitled to consultative roles in this process.
Thank you for the opportunity to comment. If we may be of further assistance, please contact Shina
duVall, Section 106 Compliance Manager, at (303) 866-4674 or shina.duvall@chs.state.co.us.
Sincerely
A,-)
dward C.
