Cattany <br />INTEROFFICE MEMORANDUM Division Director <br />Natural Resource Trustee <br />TO: Dan Mathews <br />FROM: Mike Boulay ?j <br />DATE: January 4, 2008 <br />SUBJECT: Western Fuels-Colorado (WFC), New Horizon Mine (Permit No. C-81-008), <br />Permit Renewal No. 5 (RN5) <br />Based on some of the conclusions drawn from our recent telephone conference call with WFC <br />regarding Technical Revision No. 55 and the landowner objections, I am requesting your <br />assistance with the Permit Renewal No. 5 adequacy review. During the conference call we <br />discussed the topsoil replacement concerns raised by JoEllen Turner and the potential for <br />modifying topsoil salvage and replacement practices. Since this is a separate issue not already <br />addressed by your recent TR-54 and TR-55 review letters, I believe that it would be prudent to do <br />this review as part of the permit renewal adequacy review. I am asking that you perform this <br />review due to your expertise in this area and the affect that topsoil replacement may have on the <br />pending revegetation plan revision. Please review the current permit requirements and <br />reclamation practices regarding topsoil salvage and replacement, and make recommendations for <br />modifications if you determine that they are warranted.
