Ill. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a Partial Inspection of the New Horizon Mine conducted by Marcia Talvitie and <br /> Sandy Brown of the Colorado DRMS during the afternoon of 14 April 2009. No one <br /> represented the operator, Western Fuels-Colorado, during the inspection. <br /> Prior to the inspection, the DRMS personnel (with the addition of Dan Mathews) had <br /> attended a meeting with Western Fuels and the Morgan family to discuss the Morgans' <br /> objection to the Division's proposed approval of TR-57 (Soil Resource Information and <br /> Topsoil Redistribution). <br /> The field inspection was brief, and was conducted visually from the public roads <br /> adjacent to the permit area. Weather conditions were cloudy. <br /> Topsoil <br /> Topsoil from the A Horizon on the Morgan property (Prime Farmland) in advance of <br /> mining operations had been previously windrowed by a bulldozer. At the time of the <br /> inspection, the shovel was loading the topsoil into haul trucks (Figure 1), which then <br /> transported the dark brown material to the designated "A Lift" stockpile on Morgan <br /> property east of the active pit. <br /> Air Resource Protection <br /> A water truck was observed spraying the haul roads to control dust. <br /> New Horizon Mine C-1981-008 14-Apr-2009 <br />
