ORIGINAL - PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1997-nRA <br />INSPECTION DATE: 2/I7/n9 INSPECTORS INITIALS: -RK- <br />OBSERVATIONS <br />The Division conducted a monitoring inspection of the site in a response to a citizens <br />complaint. The Division was contacted by a citizen requesting a site visit, because they <br />believed the operator was not in compliance with the approved reclamation plan. <br />The site was last inspected on March 25th 2008 in a response to a similar concern by a <br />citizen. The inspection at that time found the operation to be in compliance with the <br />approved permit. <br />Present during the March 17, 2009 inspection were Mr. Tony Waldron of the Division, Mr. <br />Brad Mueller and Mr. Matt Mueller of Siloam Stone Inc. Site was active at the time of the <br />inspection.. The entire permit area consists of three distinct permit areas.M-1977-326, A <br />Robinson Brick Clay Mine, of which approximately 2.8 acres are being utilized by the <br />Bedrock mine as a rock storage area.M-1997-094 A 110 6.3 ACRE PERMIT THAT WAS CONVERTED <br />FROM A 111 PERMIT (M-1997-118). <br />According to the latest annual report dated March 16,2009,the operator stated a total of <br />16.9 acres affected in stages 1 and 3 acres in Stage 2. It also states that the old stone <br />storage area of 31.4 acres, which they stated, areas do not require reclamation due to the <br />fact that they were designated as historic industrial use areas. However, there was <br />nothing in the records of the permit that indicates as such. The post miming land use for <br />the site as approved in the reclamation plan in 1997 is Rangeland. <br />Prior to the physical inspection, DRMS and the operators discussed the potential confusion <br />of the permit affected boundary, given the fact that there are three permits(M-1977-330), <br />m-1997-086 & (M-1997-086) included in the overall permit boundary. Their also appears to <br />be some confusion as to how much acreage is allowed in the old rock storage area. Unless <br />one is very familiar with the area or the project, it can create confusion to staff and <br />operator and the public. Also discussed the language in the mining plan about areas that <br />are to be used as storage areas and not require a reclamation warranty. <br />As stated above, the site was active at the time of the inspection. Walked and looked at <br />the rock storage areas. In addition noticed some slabs of rock scattered along the North <br />side of the permit area. <br />Since the operator planned to submit a Technical Revision to increase the affected area, <br />DRMS recommends the operator either have the affected areas surveyed, utilizing a surveyor <br />or a GPS, and place appropriate affected area boundary markers. The markers should <br />delineate the areas to be affected at any given year. The technical Revision must be <br />submitted no later than June 17,2009.The revision must also include in the maps, locations <br />of all top soil stock piles, active mining and rock storage areas. The revision must also <br />clearly detail, Major, Moderate and Minor affected areas for reclamation warranty <br />calculation purposes. Once the technical revision is submitted, DRMS will adjust the <br />warranty.
