Only two of <br />the five letters received had return addresses, and therefore, the Division responded to <br />two of the objection letters. For reference we are including a copy of our January 11, <br />2008 letter which transmitted the RN-5 objection letters to WFC and copies of our <br />preliminary responses to interested public parties regarding their objections to RN-5. <br />These are included as Attachment 2. <br />As part of the adequacy review, the Division performs a detailed reclamation cost review <br />and estimate. The Division has not yet completed the permit renewal cost estimate, but <br />we will forward the estimate upon completion. Several of the adequacy questions below <br />are related to the reclamation estimate. <br />Rule 2.03.5 Compliance Information <br />The Division has checked the AVS system against the current permit application package <br />permit pages dated August 2006 and has the following questions. <br />Western Fuels-Colorado: <br />1. On page 2.03-6, dated August 2006, the following is listed: <br />Jim Soehner Secretary/Treasurer Start date April 1992 <br />But in AVS, the following is listed: <br />Jack N. Young Secretary/Treasurer Start date April & March 1992 <br />Is Jim Soehner the current SEC/TRS or is Jack N. Young the current SEC/TRS? <br />Please update the permit page 2.03-6 to show the correct SEC/TRS so that the <br />Division can update AVS appropriately. <br />2. On page 2.03-6, dated August 2006, the following is listed: <br />Bill Bird No Position listed Start Date November 2005 <br />Please updated page 2.03-6 to show what position Bill Bird is holding so AVS <br />may be updated appropriately. <br />Tri-State Generation: <br />3. Please update Tri-State's information in the permit if there are any updates since <br />August 2006.
