December 31, 2007 i` l ' s
Division of Reclamation, Mining, and Safety JAN 10 2006
1313 Sherman Street Division otr haciarnaSon,
Room 215 Mining and safety
Denver, Colorado 80203
Re. Technical Revision to the New Horizon Mine Permit No. C-81-008 . This Technical
Revision is to Section 2.05.4(2)e. This is by Western Fuels-Colorado (WFC) in Nucla, CO.
Dear Sirs:
I am writing this letter as a formal protest to the application.ftm Technical Revision to the
Nev; Horizon Mine Permit No. C-81-008. Also to the renewal of their existing permit. This
Technical Revision covers the change in Success Standards i»Irrigated Pasture m a
standard to a reference area
I have lived in Nucla most of my life and I ern a landowner in the area affected by WFC. I am
familiar with this area, the people who are landowners, and the agricultural uses of the land
in the area. Agriculture has been a mainstay of this area since Nucla became a town and was,
in fact, the reason the town of Nucla evolved in 1906. Land in this area has been and still is
utilized for crops such-as alfalfa, corn, wheat, and oats, etc. Some-oftheland is used as irrigated
pastureland, but this is usually the inferior land that is not as well suited for crop production.
.Even crop land,. once harvested , is pastured. This is not the primary use of the acreage and
should not be how it is classified.
This is one reason for my protest. The Morgan property which is the property,
in question, is irrigated farmland. After inspection of the revision; this
property along with Bensons, Lloyds, Johnsons, etc. are all to be classified
as DRYLAND. This is unheard of. Just prior to the take over of the -Sunshine
Comer of Morgans, We purchased 200 ton of prime Alfalfa Hay. The Morgans
have always planted Alfalfa and the Sunshine Place was some of the prettiest
fields in the country. These lands have always been irrigated crop lands with
very high yields.
I am objecting and would like to see all of this land in question put back the
way it was or better prior to the leases. Feed is not overly plentifUin Nucla
and all of these prime farmlands should be put back as such. Dry land is
out ofthe question and there is water available to put these lands back.
Some oft he Morgan property being mined has some of the best topdsoil
here. -
Thank you,
