Cattany <br />Division Director <br />Natural Resource Trustee <br />FROM: Joe Dudash `j 1/ <br />RE: Bear No. 3 Mine, Permit No. C-1981-033, Bear Coal Company <br />SL-4, Partial Phase One Bond Release, Preliminary Submittal Adequacy Review <br />At the Division's request, Bear Coal Company (BCC) has submitted preliminary information concerning <br />a Partial Phase One Bond Release (SL-4) for the Bear No. 3 Mine. I am requesting your assistance in the <br />review of the reclamation cost estimate and the amount by which the liability would be reduced if we <br />approve the bond release application.. <br />The general idea in this preliminary adequacy review is to see if the proposed bond release can reduce the <br />remaining reclamation cost estimate to no more than $160,000.00 so that Permit Renewal No. 5 can be <br />approved. The reclamation cost estimate that was calculated in RN-5 was $279,224.00. BCC currently has <br />a bond in house amounting to $160,000. If the details can be worked out, BCC will formally submit SL-4. <br />If the details can not be worked out, we may have to proceed differently. <br />Attached is one copy of the preliminary SL-4 submittal. The attached map is the only copy that we have. <br />Since this is a preliminary submittal and BCC plans on formally submitting SL-4 in a couple of months, <br />this gives us some time for review. Therefore, I would appreciate your comments by April 30, 2009. <br />If you need any additional information, please let me know.
