The BLM hereby accepts Rimrock as the operator of <br />record for this project's operations along with all liabilities and responsibilities associated with that <br />project. We have some issues that need to be resolved and advisement to pass along. <br />The BlueRock J Bird Mine that Rimrock has taken back from BlueRock has a BLM casefile number of <br />COC 68907. Rimrock, as operator, has an outstanding mining notice for the J Bird area with a BLM <br />casefile number of COC 68883 (CDRMS number of P-2005-014) and a $7,702 bond obligated. BLM <br />does not permit multiple case files for the same project. The COC 68883 mining notice, which expires <br />on July 7, 2009, needs to be incorporated into the J Bird plan of operations that you have recently <br />taken back. We need clarification about what activities in the notice have been completed and what <br />activities will be transferred to the plan, and then we'll close that notice file. We also need to have the <br />bond adjusted to account for reclamation work for those activities. We understand that your bond <br />amount as accepted by the CDRMS is $17,146. Until the issue of what activities Rimrock plans on <br />completing are accounted for, we will accept this amount. Along with this we'd like to have a written <br />confirmation what your mining and exploration plans are for the J Bird Mine since they may not <br />coincide with those that BLM has authorized for BlueRock. Any activities not approved must be <br />submitted as a mining plan amendment which will require a NEPA adequacy review and possible EA <br />amendment. <br />Therefore within 90 days of receipt of this letter we require that Rimrock provide us with the J Bird <br />operating plan that includes the consolidation of your existing mining notice into the J Bird plan of <br />operations and includes a revised reclamation plan and bond calculation if different from BlueRock's <br />approved plan.
