Cattany <br />Division Director <br />Natural Resource Trustee <br />Re: Last Chance Mine, File No. M-2008-012, Amendment (AM-01) of a 110(2) Hard Rock/Metal <br />Mining Reclamation application to a 112d(1), Designated Mining Operation Application. <br />Dear Mr. Carter: <br />The Division of Reclamation Mining and Safety (DRMS) received Nuvemco's amendment / conversion to the <br />application of the above referenced 110(2) application on April 13, 2009. The amendment is required due to <br />changes in the law which went into affect on May 20, 2008 per House Bill 1161. Nuvemco had until April 15, <br />2009 to submit the amended application. Based on several factors Nuvemco has elected to convert the <br />application from a 110(2) to a I I2d(1). Due to the change in the law and a desire to change from a 110 to a <br />112 the amendment / conversion does not fit exactly into the rules. This is unique to this one application as it <br />was the only one submitted and under review at the time of the rule change. Therefore, staff has had to review <br />the amendment / conversion completeness based on several rules. <br />Per Rule 1.8.1 DRMS notes that the applicant is filing the amendment / conversion hence forth known as the <br />conversion CN-01 to the original application M-2008-012. Per Rule 1.8.1(3) and (6) the conversion constitutes <br />a new filing with new public notice requirements and all due dates set a new. Per telephone conversations it is <br />noted that county clerk filing is to be completed by April 15, 2009 and all required re-notices have been sent <br />out. Therefore the application is considered complete once staff has confirmation that the conversion file has <br />been placed at the County Clerk's office as required. Please begin publishing the required Public Notice per <br />Rule 1.6.5. within 10 (ten) days of receipt of this letter and after the file has been delivered to the County <br />Clerk's Office. <br />Per Rule 1.8.1(3) the new decision date for this application is set for September 15, 2009. Based on the amount <br />of information for water, geo-chemical analysis and engineering that is required for a 112 DMO, the Division <br />is calling the application complex. The complex designation allows the Division an additional 60 days for <br />review in addition to the normal 90 for a normal 112 permit per Rule 1.4.1(7). Please note that should all <br />issues be addressed prior to the decision date and after the public comment period ends without objections staff <br />may issue a decision at that time.
