Cattany <br />Division Director <br />Natural Resource Trustee <br />in December of 2008 you contacted the Division of Reclamation Mining and Safety (DRMS) in regards to <br />reclamation issues at the above referenced site. Staff responded back that when weather allowed the site would <br />be inspected as part of the normal monitoring program by DRMS and that reclamation would be part of that visit. <br />On March 25, 2009 DRMS staff inspected the site. Rule 3.13 notes that "all reclamation shall be carried out to <br />completion with all diligence, and that each phase of reclamation shall be completed in five(5) years from the date <br />that the Operator informs the Board or Office that such phase has commenced. The 5 year period may be applied <br />separately to each phase as it commenced through the life of the mine." Please find enclosed the last two annual <br />reports submitted to the Division. Those reports clearly show that Lafarge finished mining in the 2006^2007 <br />reporting period and began reclamation in the 2007"2008 period. By Rule Lafarge has at least 4 more years to <br />meet the reclamation standards and if extenuating circumstances arise they can request an additional five (5) <br />years from the Mined Land Reclamation Board. <br />As noted in the initial response back to you DRMs does not get involved with civil legal matters.
