The problems should be corrected by the dates given, or they will become possible <br />violations. The possible violations should be corrected by the dates given to reduce their severity when considered <br />by the Mined Land Reclamation Board. The inspector noted on the previous page should be notified of all <br />corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />CORRECTION <br />DATE <br />1. During the inspection, it was discovered that there was no sign posted at the entrance to 05/ 15/09 <br />the site. This is a problem related to Section 3.1.12(1) of the Construction Materials Rules <br />and Regulations for failure post a sign which is clearly visible from the access road with the <br />name of the Operator, a statement that a reclamation permit for the operation has been <br />issued by the Colorado Mined Land Reclamation Board; and the permit number. <br />PB or PV: PB_ <br />TOPIC(S): _SM_ <br />Corrective Action: Corrective Action: Place the appropriate sign at the access point to the <br />site within thirty (30) days of rP ipt of this inspection report and send photos to DM for <br />verification. <br />2 05/ 15/09 <br />During the file review conducted as part of the inspection it was discovered that no <br />mining or reclamation activities have occurred at the site since before 2005. This is a <br />problem related to 34-32.5-113(11(b) of the Colorado Revised Statutes and Rule 6 4 4(e) of <br />the Construction Materials Rules and Regulations for failure to file a notice with the board <br />sating the reasons for nonproduction, a plan for the resumption of production, and the <br />measures taken to comply with reclamation and other necessary activities as established <br />by the board to maintain the operation in a nonproducing state after temporarily ceasing <br />production for one hundred eighty days or more. <br />PB or PV: _PB_ <br />TOPIC(S): -AR <br />Corrective Action: Inform the Division as to when mining activities will recommence at the <br />site. If the date exceeds one year, s submit the nQcescarv information to place the it into <br />Temporary Cessation status within thirtv (30) days of receipt of this report
