In particular, you inquired as to the necessary setback
between our line and any mining activities.
It is my understanding that the current highwall of the mining activity is approximately 190 feet
from our transmission line. Please note that our transmission line lies within an easement 75 feet
in width, 37.5 feet on each side of the centerline. Any mining activity which occurs outside of
Western's easement is acceptable since it would be occurring beyond Western's property rights.
If there comes a time when you wish to excavate within Western's easement, we would require
advance notice and permission to ensure all mining activity is done safely, access is maintained
to Western's structures at all times, and the integrity of Western's structures is maintained.
I trust this adequately responds to your request. Should you have any questions, please contact
me at (720) 962-7272.
Sincerely,
Steven W.
