Memo to File
January11, 2008 Page 2
on since the submittal of TR-55. Here are a few new complaints that they conveyed to
me during the phone call:
Gravel was mixed in to the topsoil that was placed on their land and then covered
with more topsoil.
¦ They had some new complaints regarding the post-mine topography being too
sloping on their property and a ditch will be needed around the perimeter.
Bud Benson's property to the north was put back 25 feet higher than it should
have been.
¦ They also had a complaint that the CC Ditch Company did not leave stub outs on
their property like they were supposed to during the recent pipeline project.
¦ The seed mix was incorrect that they are using on Pond 011 and the topsoil pile.
I reiterated that they should follow up with a written request for an inspection if they feel
that a violation has occurred or they have a safety concern. We also discussed the
upcoming revision to replace TR-55 and I guaranteed them that we will not approve
anything on their land or anyone else's until we have landowner written comments
regarding any changes to the post mine land use or reclamation plan. They appeared to
be satisfied with my answers and indicated that they would be patient and wait until they
hear from the Division or from WFC regarding the Morgan's input on any potential
changes to the revegetation or reclamation plans.
C: Sandy Brown, Marcia Talvitie, Dan Mathews
