Mark McLean <br />April 13, 2009 <br />Page 2 <br />Glover Analysis data provided in the cover letter of the submittal include the following: <br />• A distance to the river of 2400 feet <br />• A distance of impermeable boundary of 5,000 ft (approximate distance to the <br />Excelsior Ditch) <br />• Transmissivity of 100,000 gpd/ft <br />• Storage coefficient of 0.2 <br />Your stream depletion analysis is also attached (See attached Table 3) providing a monthly <br />distribution of the steam depletion. You have calculated total stream depletions to be 15.90 acre- <br />feet for the April 1, 2009 through March 31, 2010-plan year. Post plan year depletions are projected <br />to be 4.23 acre-feet. <br />REPLACEMENT <br />During April 2009 through March, 2010, leased fully consumable water from the Pikes Peak <br />Water Authority, available pursuant to a 40-year lease, will be provided to cover mining depletions. <br />The lease provides that Pikes Peak will deliver the quantity required for the Evans #2 Pit to the <br />Arkansas River at or near the Avondale gage (USGS Gaging Station No. 07109500). The total <br />amount available is up to 175 acre-feet. The transit loss down Fountain Creek and the Arkansas to <br />the delivery point is estimated at approximately 10 percent. Attached Table 4 shows the proposed <br />accounting forms. <br />Post Plan Depletions <br />Projected post plan depletions are shown at the bottom of attached Table 5. Projected post- <br />2009 plan year depletions are 4.23 acre-feet. The long-term replacement water lease agreement <br />with Pikes Peak Water Authority provides a means to supply replacement water for 2009 post plan <br />depletions. <br />The State and Division Engineers have reviewed the plan and the adequacy of each source <br />of water provided for use as augmentation water, including, where necessary, the historical <br />consumptive use of each water right, and return flows from diversion of waters imported into the <br />Arkansas River Basin or other fully consumable waters proposed for use as augmentation water. <br />CONDITIONS OF APPROVAL <br />This substitute water supply plan is hereby approved pursuant to Section 37-90-137(11), <br />C.R.S., subject to the following conditions: <br />1. This plan shall be valid through March 31, 2010, unless otherwise revoked or modified. <br />2. Active mining of the site shall not exceed 50 acres unless an amendment to this plan has been <br />approved. <br />3. The mined cell must be maintained in a de-watered state. <br />4. The actual allowed water surface exposure may not exceed 0.5 acres. Documentation of water <br />surface area may be required by the Division Engineer in the form of an aerial photo evaluation <br />or survey by a Professional Land Surveyor during the plan year or in years covered by <br />subsequent renewals of this plan.
