CERTIFIED MAIL <br />RETURN RECEIPT NO. 7007 0220 0000 6705 6556 <br />April 14, 2009 <br />Mr. Jim Dupler AGGREGATE <br />Division of Reclamation, Mining & Safety <br />1313 Sherman Street, Room 215 INDUSTRIES <br />Denver, CO 80203 <br />Re: Permit No. M-1999-021- Stegner Farms - 112c Annual Fee and Report <br />Dear Jim: <br />Enclosed is Check No. 340786 in the amount of $791.00 together with the annual report form and a <br />drawing for the above-referenced permit. During the permit year ending March 6, 2009, mining activity <br />continued in previously disturbed areas. Reclamation activity included additional backfilling and <br />completion of all reclamation slopes. An overburden stockpile on the west side of site was placed into <br />south and west fill areas, extending previously placed reservoir slope fill areas, in accordance with the <br />land owner's request. Silt ponds along the south border were covered with 6 inches of uncompacted <br />overburden and a shallow swale was graded through this area. All waste and silt material from northeast <br />silt ponds was removed and placed in former fresh water ponds on the pit floor, and the former silt ponds <br />were filled with material from the west overburden stockpile. <br />Following completion of all sloping around the mine perimeter, a leak test for the slurry wall that was <br />constructed in 2000 was conducted by TetraTech. The test was conducted from December 1, 2008 <br />through March 3, 2009. A report of the test was submitted to and subsequently approved by Jana Ash, <br />Water Resource Engineer with the Colorado Division of Water Resources. A copy of the approval letter <br />together with a copy of the construction observation report for the slurry wall will be submitted with a <br />request for bond reduction by separate letter. <br />While sales of stockpiled material is expected to continue throughout 2009, no additional extraction <br />activity is anticipated.
