One additional stock pond (T-3), located in the "Wadge Pasture" area near the corner of Sections 1, 2, <br />11, and 12, had been overlooked and was not identified as a permanent impoundment during the <br />original TR-35 permitting action. Stock pond T-3 was subsequently approved as a permanent <br />impoundment based on required information presented in Technical Revision 46, which was <br />approved by the Division on December 24, 2008. The following narrative has been. modified slightly <br />from the SL-I Phase 1 bond release findings to incorporate Phase II determinations, and applies to all <br />of the listed stock ponds, including the recently approved Stock Pond T-3. <br />All of the permanent stock ponds are constructed in reclaimed areas and are not <br />primary sediment control structures. The permanent stock ponds provide water for <br />livestock and wildlife and will enhance both postmine land uses. Stock ponds are <br />routinely inspected during complete inspections. All stock ponds have a capacity no <br />greater than two-acre feet and embankment height no greater than five feet as <br />measured from the invert of the spillway to the upstream toe of the embankment. Stock <br />pond inlets, embankments, and spillway structures are stable. All side slopes and <br />surrounding areas are stable and well vegetated. No problems were noted with any of <br />the stock ponds during the Phase I or Phase II bond release inspections. <br />The permanent stock ponds have met all criteria required for final, Phase III bond release, with the <br />exception that water quality suitability demonstrations pursuant to Rule 4.05.9(13)(a), have not yet <br />been provided. Narrative on page 1 of permit Appendix 13-9 states that the water quality sampling to <br />document compliance will be obtained during the bond release period. In a letter dated November 17, <br />2008, SCC stated that the sampling would be conducted during the 2nd quarter of 2009, and that the <br />required suitability demonstrations would be submitted to the Division shortly thereafter, upon receipt <br />of laboratory analyses. Based on observations. made during the inspection, and further based on <br />documentation included in the approved permit, including the commitment to provide water quality <br />suitability demonstrations to the Division during the liability period, the 13 permanent stock ponds <br />listed in this section do meet applicable criteria for Phase II bond release. Three of the listed stock <br />ponds (T-17, T-20, and T-29) are located either wholly or partially within Bond Release Block 4 <br />(BRB-4), the remaining ponds are located in Blocks 2 or 3. <br />Permanent Impoundment Summary: Permanent sediment pond impoundments evaluated (Pond 004, <br />Pond 008, and PECOCO) all meet the criteria for Phase II bond release. All 13 permanent stock <br />ponds evaluated also meet the criteria for Phase II bond release. The Division's SL-3 Phase II bond <br />release proposed approval decision will not include Pond 004, Pond 008, or Stock Ponds T-17, T-20, <br />or T-29, because these ponds are located within Bond Release Block 4 (BRB-4), which is excluded <br />from the proposed Phase II release area. The PECOCO pond and all listed stock ponds other than T- <br />17, T-20, and T-29 will be included within the Division's proposed Phase II bond release approval. <br />Water quality suitability demonstrations pursuant to Rule 4.05.9(13)(a) will be required for all <br />permanent stock ponds prior to approval of final, Phase III bond release. <br />17
