Public Notice <br />The Colorado Division of Reclamation, Mining and Safety (Division) has begun the process of <br />terminating its jurisdiction over the reclaimed Grassy Gap No. 1 Mine. The mine is located approximately <br />7 miles southeast of Hayden, Colorado, 4.5 miles west of Routt County Road No. 27 (Twentymile Road) <br />on Grassy Creek. The permit area lies within T5N, R87W of the a PM, Sections 20, 21, 28, 29 and 31. <br />The permit area consists of 1086.0 acres, of which 336.9 acres were disturbed and reclaimed by mining <br />activities. Termination of jurisdiction is proposed for the entire 1086.0 acres. Surface land ownership is <br />private. Coal mined within the permit area was under private and federal ownership. <br />The Grassy Gap No. 1 Mine was permitted by Rockcastle Coal Company. The permit was issued April <br />23, 1985. The mining operation ceased extraction of coal and became inactive in June of 1985. The <br />permit expired April 23, 1990 and was not renewed. Permit revocation and bond forfeiture proceedings <br />were initiated by the Division on August 23, 1990. In accordance with C.R.S. Sections 34-33-123(7), 34- <br />33-124(4) and Rule 3.04 of the Rules and Regulations of the Colorado Mined Land Reclamation Board <br />for Coal Mining, permit C-1981-039 was permanently revoked by the Colorado Mined Land Reclamation <br />Board effective June 23, 1993. Rockcastle Coal Company forfeited $35,000.00 to the Division for <br />completion and maintenance of remaining work. <br />The majority of the mine site was reclaimed by Rockcastle Coal Company. In January 1995, the Division <br />returned $10,000.00 to Rockcastle Coal Company for completion of weed control in accordance with a <br />permit revocation agreement. Over the ensuing 12 years, the Division conducted the remaining <br />reclamation and maintenance work. All monies associated with the forfeited bond have been used for <br />final reclamation tasks and site maintenance. <br />Stability of the reclaimed land, successful revegetation, minimization of hydrologic impacts within the <br />permitted area and prevention of hydrologic impacts outside the permitted area demonstrate that the site <br />has been successfully reclaimed. At the request of the surface landowner, the pit access roads, Pond 4, <br />and Pond 5 have been retained as permanent structures. <br />Written comments, objections, and requests for an informal conference or a formal public hearing before <br />the Mined Land Reclamation Board may be submitted to the Colorado Division of Reclamation, Mining <br />and Safety, 1313 Sherman street, Room 215, Denver, CO 80203 within 30 days of the last publication of <br />this notice
