I am requesting assistance with review of Kerr Coal Company's submittal of the 2008 Annual Hydrology
Report, in accordance with Rule 4.04.13(4). The 2008 AHR for the Marr Mine and Loadout was received
March 31, 2009. This report was submitted as a stand alone report and not as a part of a technical revision.
The mine is a reclaimed surface mine along with a mostly reclaimed load out facility located 12 miles away from
the mine. All but 8 acres at the mine site were approved for final (phase III) bond release in January 2009.
Water monitoring wells at the mine location were sealed in 2008. All remaining ponds at the mine site (A, B, D,
E, & F) were approved to remain as permanent ponds. The Loadout pond has not been approved to remain as
a permanent structure at this time, nor has it been reclaimed. Subsurface water monitoring wells are still
functional at the Loadout facility. Thank you for your help in this review.
