("Applicant") <br />in accordance with 37-90-137(11), C.R.S. The Applicant shall be responsible for compliance <br />with this plan, but the State Engineer's Office may also pursue the landowner for eventual <br />compliance. The required fee of $257.00 for the renewal of this substitute supply plan has been <br />submitted (receipt no. 3631087). The SWSP was originally approved on July 20, 2005, and was <br />most recently renewed on November 9, 2007. <br />Note Condition of Approval 8 for actions that must be taken prior to commencing <br />mining at the site. <br />Plan Operation <br />The Duckworth Pit mining site (WDID: 0603005) is located east of Boulder Creek, <br />southeast of Longmont, in the South 1/ of the Northeast '/4 of Section 16, Township 2 North, <br />Range 68 West, 6th P.M. Mining at the Duckworth Pit has not commenced and there is no <br />exposed ground water at the site. According to information submitted with the SWSP renewal <br />application, the Applicant does not anticipate mining or exposing any ground water at the <br />Duckworth Pit before the end of the proposed approval period. However, the application <br />requests approval for a plan that would enable the Applicant to begin mining the site any time <br />during the proposed approval period.
