Box 60340 Division Director <br /> <br />Grand Junction, CO 81506 Natural Resource Trustee <br />RE: Red Cliff Mine (Permit No. C-2008-086) <br />Transmittal of Comment Letter and Preliminary Adequacy Review <br />Dear Mr. Heaps: <br />The Division of Reclamation, Mining and Safety (Division) received the attached letter dated <br />April 7, 2009 from Earth Justice. In this letter they are asking about possible methane <br />degasification wells (MDW's) associated with the proposed Red Cliff Mine. The Division had <br />also asked a question regarding MDW's in our May 5, 2008 incompleteness letter. Issue number <br />10 of the letter identified the lack of plans for methane degasification. CAM responded on May <br />22, 2008 saying, that it is unlikely methane degas wells will be required during the life of <br />operation as defined on amended page 2.05-2. To clarify the permit application, the Division is <br />requesting CAM to discuss methane degasification. If appropriate, the application should be <br />updated with plans for MDW's and associated disturbances. Your responses should be prepared <br />and submitted to the Division along with your responses to our initial adequacy review letter <br />dated August 29, 2008 for the proposed Red Cliff Mine. <br />If you have any questions, please contact me or Mike Boulay. <br />Sincerely, <br />Sandra L.
