Cattany <br />Division Director <br />Natural Resource Trustee <br />On April 3, 2009, the Colorado Division of Reclamation, Mining and Safety determined the <br />application for the WSG-Hribar Pit to be complete for the purposes of filing. Pursuant to Rule <br />1.4.6(1), the decision date for the application is May 4, 2009. Please be advised that the <br />application for the WSG-Hribar Pit may be found deficient and may be denied on May 4, 2009 <br />unless the following adequacy issues are addressed to the Division's satisfaction. <br />1. Pursuant to Rule 1.6.2(1)(g), please provide proof of publication for the newspaper notice <br />required under Rule 1.6.2(1)(d). <br />2. Pursuant to Rule 1.6.2(1)(g), please provide proof of notice to all owners of record of the <br />surface and minerals rights of the affected land, and the owners of record of all land surface <br />within 200 feet of the permit boundary, as required under Rule 1.6.2(1)(e)r <br />The Division accepts the reclamation cost estimation, totaling $18,200, as proposed on page 26 <br />of the application. <br />Please contact me at the Division's office in Durango at 691 County Road 233, Suite A-2, <br />Durango, CO 81301, phone (970) 247-5469, if you have any questions. <br />Since <br />Wallace H.
